Two common methods used for calculating personal injury settlement values are the multiplier and the calculation method. These methods provide rough estimates and are often used as starting points for settlement negotiations with insurance companies or during legal proceedings.
The calculation method is primarily employed to assess the value of "economic" or "special" damages, which are losses with specific dollar amounts, such as medical bills and repair invoices. This straightforward approach enables injured individuals and insurance companies to estimate special damages by summing up the actual expenses incurred due to the accident.
Example:
Imagine you were in a car accident, resulting in $10,000 in medical bills, $10,000 in lost wages, $2,000 for vehicle repair, and $1,500 in transportation and miscellaneous expenses. The total economic damages result in $23,500
General damages, such as pain and suffering, can be evaluated through the multiplier method. This method involves multiplying the total special damages by a factor between 1.5 and 5 to estimate the general damages. Higher multipliers like 4 or 5 are typically reserved for cases involving catastrophic injuries with substantial and enduring consequences.
Example:
If your economic damages (medical bills, lost wages, etc.) total $50,000 and you have a moderate personal injury lawsuit (severity level 3) with a chosen multiplier of 3, your estimated non-economic damages would be $150,000. Adding this to your economic damages results in a total settlement value of $200,000.
How Much Money Will I Pay My Lawyer After My Settlement?
