COMMING TO WORK IN SPAIN:

Spain faces challenges in filling certain job positions. The new reform of our immigration regulation focuses on the Catalog of Jobs Difficult to Cover. This includes expanded categories, especially in the construction sector.

The reform aims to address two issues: combating the underground economy and allowing companies to hire personnel from outside Spain. This could lead to more flexible recruitment from abroad.

FAMILY MEMBERS OF SPANIARDS:

The focus is also on family members of Spaniards. After the 2022 immigration regulation reform, direct family members were included in the Family Ties category. Positive but deemed insufficient, especially for certain relatives who still need to prove dependency, similar to the requirements for a Community Card.

A new regulation specifically for family members of Spaniards may be created, or modifications to the Family Ties category might occur.

SINGLE PERMIT:

As announced last year, the immigration regulation reform aims to simplify existing permits. The idea is to move towards a single permit, consolidating various situations under one authorization. This aims to reduce the number of permits manageable in Spain.

IMMIGRATION REGULATION REFORM 2024:

The goal is to simplify procedures, enhance migrant rights protection, reduce existing permit categories, streamline documentation, and reinforce the rights of migrants.

It will also include the transposition of two European directives approved during the Spanish presidency: the “Single Permit Directive,” streamlining the combined work and residence permit, and the “Long-Term Residence Directive,” improving the rights of long-term residents and their families.

CHANGES IN 2024:

As in previous years, the plan is to modify the Immigration Regulation through a Royal Decree. The focus is on simplification and reducing the multitude of permits currently in place.

Our laws and immigration regulations govern numerous permits, authorizations, renewals, modifications, and permit compatibilities, each with distinct requirements and documentation. The reform seeks to eliminate redundancies and confusion caused by similar permits and authorizations.

Apart from legal changes, a shift in perspective is necessary in immigration offices, moving away from a restrictive interpretation. Despite legal amendments promoting legal residence, some offices still apply regulations rigidly. Alongside legal changes, there must be a shift in the application and interpretation of the law.
