In most jurisdictions, the use of deadly force is justified only under conditions of extreme necessity as a last resort, when all lesser means have failed or cannot reasonably be employed. Firearms, bladed weapons, explosives, and vehicles are among those weapons the use of which is considered deadly force.

When deadly force reasonably appears to be necessary to prevent the commission of a serious offense against a person(s) in circ*mstances presenting an imminent danger of death or serious bodily harm (e.g. sabotage of an occupied facility by explosives).

The reasonableness of the use of force should also be evaluated by considering (1) the severity of the crime at issue, (2) whether the suspect poses an immediate threat to the safety of the officers or others and (3) whether the suspect is actively resisting arrest or attempting to evade arrest by flight.

To seize someone, an officer may yell “Stop!” The officer may use handcuffs, a baton, or firearm to make him stop. A seizure must be objectively reasonable – meaning reasonable in its inception, the degree of force used, and its duration.

When can military use deadly force? ›

(a) Inherent Right of Self-Defense. Deadly force is authorized when DoD unit commanders reasonably believe that a person poses an imminent threat of death or serious bodily harm to DoD forces. Unit self-defense includes the defense of other DoD forces in the vicinity.

The principle of necessity has three interrelated elements: the duty to use non-violent means wherever possible; the duty to use force only for a legitimate law enforcement purpose; and the duty to use only the minimum necessary force that is reasonable in the prevailing circ*mstances.

The Supreme Court stated: “If… there is probable cause to believe that [the suspect] has committed a crime involving the infliction or threatened infliction of serious physical harm, deadly force may be used if necessary to prevent escape, and if, where feasible, some warning has been given.”
